Terms and Conditions

1. General

These terms and conditions (“Terms and Conditions”) are the terms and conditions upon which Bough&Bauble makes its website available to you and upon which Bough&Bauble supplies the goods displayed on its website to you. Please read these Terms and Conditions before placing an order with Bough&Bauble. Upon placing your order, these Terms and Conditions shall be incorporated into the contract between you and Bough&Bauble. We reserve the right to supplement and amend the Terms and Conditions and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Bough&Bauble website. Changes will be effective in respect of new orders after posting of any such change and all subsequent dealing between you and us shall be on the new Terms and Conditions.

2. Company Details

Bough and Bauble Limited is a company registered in England and Wales with company number 15177873 (“Bough&Bauble” also referred to as "we" "our" "us" in these Terms and Conditions). Bough&Bauble can be contacted via email at hello@boughandbauble.co.uk. If we have to contact you, we will do so by writing to you at the email address or postal address provided to us in your order.

3. Acceptance

All orders received by Bough&Bauble are an offer by you to purchase goods and are subject to acceptance by Bough&Bauble. Acceptance of your offer and the existence of a contract between Bough&Bauble and you only takes place when we confirm to you via email that we have accepted your order. You are entitled to cancel your order at any time prior to acceptance by Bough&Bauble. Bough&Bauble in its absolute discretion reserves the right to reject or cancel any order without giving any reason. In the event of rejection or cancellation, we will refund or cancel any payments in full via the payment method used to place the order. We will assign an order number to your order and tell you what it is when we accept your order. Please quote this order number whenever you contact us as it will help us to deal with your order more quickly.

4. Delivery and installation (if applicable) for rental Items

• As part of your checkout process on this website, you will be able to select the date for delivery of your order. We will make every effort to satisfy your selection, but this cannot be guaranteed. Where we are unable to satisfy your selection, we will contact you to make alternative arrangements. Where we are unable to make alternative arrangements, we will refund you in full via the payment method used to place the order. 
• If you wish to change your delivery date closer to the time of delivery please contact us at hello@boughandbauble.co.uk and we will try to accommodate your alternative delivery date. We will not be able to accommodate changes to delivery dates received within 72 hours of scheduled delivery.  
• It is your responsibility to ensure that an appropriate person is available at the delivery address at all times during the delivery slot. We may ask that an appropriate person signs for the goods on delivery. If delivery is attempted during your nominated delivery slot and no-one is available to accept and sign for your delivery, the goods will be retained by us and we will contact you to attempt to rearrange delivery. A redelivery fee will be charged. In the event that the goods delivered to you are incomplete or include defective goods, you must notify us promptly. You will not be charged for any incorrect goods or goods which you have not received. In any event our liability will be limited to the price of the goods not delivered or incorrectly delivered.
• It is your responsibility to ensure that Bough&Bauble is given adequate access during both delivery and collection of your goods, and to ensure that the goods are available for collection at the specified time. Any parking penalties or other costs incurred during delivery and/or collection will be your responsibility and thus all such charges will be billed to you. Any delays caused by you during delivery and/or collection which then necessitate additional journeys will be subject to additional charges. Hanging of garlands and wreaths is subject to suitable fixings and is only available where existing fixing or mounting points are supplied.
• If you opt for installation, you shall be responsible for ensuring that adequate arrangements are in place to ensure that the installation site is clear, the floor is even and there is a convenient power supply nearby. An extra charge may be made by us where we spend additional time due to delays with access and the installation site has not been prepared.
• Bough&Bauble will not accept any liability for accidents or injuries related to our goods that are caused through mishandling by you.
• We may take photographs of your property or complete a pre-existing damage form (acknowledged by you) prior to installation. In the unlikely event that we do damage your property, you will be covered by our insurance. However, claims that we can dispute with photo evidence or written agreement will incur a £50 charge per complaint to cover administrative costs.

5. Deposit and cancellation relating to rental Items

Once placed, our orders are sent straight to processing. Please do reach out to hello@boughandbauble.co.uk if you wish to modify your order but we are unable to guarantee that your order will be intercepted in time. If you cancel your order at any time after we have accepted your order, we reserve the right to charge up to 20% of the price of your order as a non-refundable deposit. If you cancel your order less than 2 months before the date by which we are due to deliver your order, we reserve the right to charge up to 50% of the price of your order. If you cancel your order less than 30 days before the date by which we are due to deliver your order we reserve the right to charge 80% of the price of the order.

6. Availability of products

All products are subject to availability. In the event of supply difficulties, Bough&Bauble reserves the right to substitute alternative goods of a comparable or superior quality subject to availability. If we are unable for any reason, to make up a satisfactory replacement, we will refund the price of your order in full. 

7. Damages and breakages for rental items

• Any damages, breakages or losses which occur after installation will be your responsibility and will be charged separately. In the event that any item is lost, stolen or damaged beyond economical repair, you shall be liable to pay us the cost of the replacement items as new.
• The costs of any damages, breakages, losses shall be paid in accordance with the terms stated on an invoice which shall be issued to you.
• All items for rent shall remain the property of Bough&Bauble.

8. Force majeure

Bough&Bauble shall be relieved of its obligations to fulfil any order to the extent that the fulfilment is prevented by failure of you, fire, weather conditions, industrial dispute, labour disturbances, or by any other cause beyond the reasonable control of Bough&Bauble. If that is the case, we will endeavour to contact you as soon as we are able to in order to reschedule your delivery date.

9. Promotions

At our discretion, from time to time, we may sell products at promotional or discounted prices. These promotions are valid from the time we introduce them to the end date of the promotion and they cannot be used for orders given before the promotion introduction date or after the promotion end date. In the event that a customer has placed an order and the price of the ordered product subsequently falls or is discounted owing to a promotion, the price of the product at the time of the order shall prevail. Our promotions are dependent on and subject to availability. We may change the terms of promotions or withdraw them altogether, at any time, and without prior notice. All orders received by Bough&Bauble pursuant to a promotion are an offer by you to purchase goods at the promotional or discounted price and are subject to Bough&Bauble’s acceptance of the offer. Promotions may either be personal and available to Bough&Bauble’s customers in general or they may be personalised to an individual customer. Where promotions are personalised, it will only be possible for the customer in receipt of the promotion to redeem the promotional code. Unless otherwise stated, we only allow one promotion code to be used per order.

10. Website

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period. We cannot and do not guarantee that any content on our website will be free from viruses and/or other code, malware that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards to satisfy the safety and reliability of content. We make no representation or warranty as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of any content of our website and to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded and we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else using the website or relying on its content.

11. Liability

Under no circumstances will Bough&Bauble be liable for (i) losses or damages that were not caused by a breach of these Terms and Conditions, (ii) any direct or indirect losses or damages, (iii) loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure, whether foreseeable or otherwise or (iii) any losses or damages that were not foreseeable to both you and us when you commenced using the Bough&Bauble service. Nothing in these Terms and Conditions limits or excludes our responsibility for fraud or for death or personal injury caused by us.

12. Personal information

It is very important that you provide accurate personal information during the checkout process as we use this information to handle and deliver orders, process payments and communicate with you about orders, products, services and promotional discounts. During the checkout process we ask for the following personal information.

• Customer’s email address – we use this information to provide a better customer experience by sending order confirmations, substitution information, dispatch confirmations and delivery confirmations. We will also use the customer’s email address for marketing communications from time to time. Please ensure that email addresses are accurate.
• Customer’s full name and address - we require this information to deliver your order. It is vital that your address is accurate. We shall not be liable for delivery failure where incomplete or incorrect delivery details have been provided.
• Customer’s telephone number – we use this information to contact customers in the event of problems with the order such as payment failures or delivery issues.

13. Payment 

Payment for all order must be made by credit or debit card on the checkout page. All payments will be handled by Shopify and Bough&Bauble do not have access to that information. Please see the following link for further information on Shopify's policies https://www.shopify.com/legal/privacy.  

14. Intellectual property rights

All intellectual property rights included on the website are owned by Bough&Bauble or our licensors. Nothing shall give you any right in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from our website.

15. Third parties

A person who is not a party to the contract between you and Bough&Bauble has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions.

16. Assignment

You may not transfer or assign any of all of your rights or obligations under these Terms and Conditions without our express written consent.

17. Waiver

If we fail to enforce any of our rights in accordance with these Terms and Conditions it shall not constitute a waiver of that right.

18. Severance

If any provision in these Terms and Conditions are held to be illegal, invalid or unenforceable, in whole or in part, under any applicable law, such provision will to that extent be deemed not to form part of these Terms and Conditions but the legality, validity and enforceability of the remainder of these Terms and Conditions will not be affected.

19. Governing law and exclusive jurisdiction

The contract concluded between us pursuant to an order placed by you shall be in the English language and shall be governed by and construed in accordance with English Law. You and Bough&Bauble agree to submit to the exclusive jurisdiction of the English courts.
